This Privacy Policy describes the policies of NO BORDERS studio on the collection, use and disclosure of your information that we collect when you use our website (https://no-borders.studio, the “Service”). By accessing or using the Service, you are consenting to the collection, use and disclosure of your information in accordance with this Privacy Policy. If you do not consent to the same, please do not access or use the Service.

We may modify this Privacy Policy at any time without any prior notice to you and will post the revised Privacy Policy on the Service. The revised Policy will be effective 180 days from when the revised Policy is posted in the Service and your continued access or use of the Service after such time will constitute your acceptance of the revised Privacy Policy. We therefore recommend that you periodically review this page.

This website is hosted by an external service provider (host). Personal data collected on this website are stored on the servers of the host.

The host is used for the purpose of fulfilling the contract with our potential and existing customers (Art. 6(1)(b) GDPR) and in the interest of secure, fast, and efficient provision of our online services by a professional provider (Art. 6(1)(f) GDPR). If appropriate consent has been obtained, the processing is carried out exclusively on the basis of Art. 6 (1)(a) GDPR and § 25 (1) TTDSG, insofar the consent includes the storage of cookies or the access to information in the user’s end device (e.g., device fingerprinting) within the meaning of the TTDSG. This consent can be revoked at any time.

Our host will only process your data to the extent necessary to fulfil its performance obligations and to follow our instructions with respect to such data.

Our website is hosted on A2 Hosting, with servers located in Europe (Amsterdam).

Every time you use our website, we collect the access data that your browser automatically transmits to enable you to visit the website. The access data includes in particular:

  • IP address of the requesting device;
  • date and time of request;
  • information about the used browser and the operating system;
  • online identifiers (e.g. device IDs, session IDs).

The data processing of this access data is necessary to enable the visit of the website and to ensure the long-term functionality and security of our systems. The access data is also temporarily stored in internal log files for the purposes described above to provide statistical information on the use of our website in order to further develop our website in terms of the usage habits of our visitors (for example, as the share of mobile devices increases, with which the pages are retrieved) and to maintain our website in general administration. The legal basis of this is Art. 6 para. 1 sentence 1 lit. b GDPR.

The information stored in the log files does not allow any direct inference to your person – in particular, we store the IP addresses only in a shortened, anonymized form.

You can subscribe to our newsletter, where we keep you up to date with news about our studio.

To order our newsletters, we use the so-called double opt-in procedure, that means we will only send you newsletters by email if you confirm by clicking on a link in our notification e-mail that you are the owner of the e-mail address provided. If you confirm your email address, we will save your e-mail address, the time of registration and the IP address used for registration until you unsubscribe from the newsletter. The sole purpose of the storage is to send you the newsletter and to prove your registration. You can unsubscribe from the newsletter at any time. A corresponding unsubscribe link can be found in every newsletter. A message to the above or in the newsletter specified contact information (e.g. by e-mail or letter) is of course also sufficient. The legal basis of the processing is your consent acc. Art. 6 para. 1 lit. a GDPR.

The newsletter is distributed via “MailChimp”, a newsletter shipping platform of Rocket Science Group, LLC, 675 Ponce De Leon Ave # 5000, Atlanta, GA 30308, USA. The e-mail addresses of our Newsletter recipients, as well as their other information described in these notes, are stored on the servers of MailChimp in the USA. MailChimp uses this information to send and evaluate the newsletters on our behalf. Furthermore, MailChimp may, according to its own information, use this data to optimize or improve its own services, e.g. for the technical optimization of the shipping and the presentation of the newsletter or for economic purposes, to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write them down or to pass them on to third parties. 

We rely on the reliability, IT and data security of MailChimp. We have signed a “Data-Processing-Agreement” with MailChimp, on data processing based on EU standard contract clauses. Mailchimp is committed to complying with the EU data protection regulations. This is a contract in which MailChimp pledges to protect the data of our users, to process it in accordance with its privacy policy on our behalf and, in particular, not to disclose it to third parties. The

The newsletters contain a so-called “web-beacon”, i.a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. It will initially collect technical information, such as information about the browser and your system, as well as your IP address and time of retrieval. This information is used to improve the technical performance of services based on their specifications or audience and their reading habits, based on their locations (which can be determined using the IP address) or access times. Statistical surveys also include determining if the newsletters will be opened, when they will be opened and which links will be clicked. For technical reasons, this information can not be assigned to the individual newsletter recipients. However, it is neither our desire nor that of MailChimp to observe individual users. The legal basis for this is your consent according to Art. 6 para. 1 lit. a GDPR. If you do not want us to analyze the usage behavior, you can unsubscribe from the newsletter or deactivate graphics in your e-mail program by default.

HOW WE USE YOUR INFORMATION: We will use the information that we collect about you for the following purposes: Marketing/ Promotional, Customer feedback collection, Targeted advertising.
If we want to use your information for any other purpose, we will ask you for consent and will use your information only on receiving your consent and then, only for the purpose(s) for which grant consent unless we are required to do otherwise by law.

HOW WE SHARE YOUR INFORMATION: We will not transfer your personal information to any third party without seeking your consent, except in limited circumstances: Ad service, Analytics.
We require such third parties to use the personal information we transfer to them only for the purpose for which it was transferred and not to retain it for longer than is required for fulfilling the said purpose. We may also disclose your personal information for the following: (1) to comply with applicable law, regulation, court order or other legal process; (2) to enforce your agreements with us, including this Privacy Policy; or (3) to respond to claims that your use of the Service violates any third-party rights. If the Service or our company is merged or acquired with another company, your information will be one of the assets that is transferred to the new owner.

RETENTION OF YOUR INFORMATION: We will retain your personal information with us for 90 days to 2 years after users terminate their accounts or for as long as we need it to fulfill the purposes for which it was collected as detailed in this Privacy Policy. We may need to retain certain information for longer periods such as record-keeping / reporting in accordance with applicable law or for other legitimate reasons like enforcement of legal rights, fraud prevention, etc. Residual anonymous information and aggregate information, neither of which identifies you (directly or indirectly), may be stored indefinitely.

YOUR RIGHTS: Depending on the law that applies, you may have a right to access and rectify or erase your personal data or receive a copy of your personal data, restrict or object to the active processing of your data, ask us to share (port) your personal information to another entity, withdraw any consent you provided to us to process your data, a right to lodge a complaint with a statutory authority and such other rights as may be relevant under applicable laws. We consider “user-generated content” to be photography, graphics, and/or video materials voluntarily supplied to us by our clients for the purpose of publication on our website or re-publishing on our social media channels. All user-generated content is associated with the client used to submit the materials. Please be aware that any content you submit for the purpose of publication will be public. Once published, it may be accessible to third parties not covered under this privacy policy.

Usage of Own Cookies
We use own cookies to note that you have been shown information placed on our website – so that it will not be displayed again the next time you visit the website.
The legal basis of this is Art. 6 para. 1 sentence 1 lit. f GDPR.

If you have given us your consent via the cookie banner displayed on our website, we use cookies and similar technologies (e.g. web beacons) to statistically collect and analyze general usage behavior based on access data. We also use analytics services to evaluate the use of our various marketing channels.

Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider of this service is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyze the behavior patterns of website visitors. To that end, the website operator receives a variety of user data, such as pages accessed, time spent on the page, the utilized operating system and the user’s origin. This data is summarized in a user-ID and assigned to the respective end device of the website visitor.

Furthermore, Google Analytics allows us to record your mouse and scroll movements and clicks, among other things. Google Analytics uses various modeling approaches to augment the collected data sets and uses machine learning technologies in data analysis.

Google Analytics uses technologies that make the recognition of the user for the purpose of analyzing the user behavior patterns (e.g., cookies or device fingerprinting). The website use information recorded by Google is, as a rule transferred to a Google server in the United States, where it is stored.

The use of these services occurs on the basis of your consent pursuant to Art. 6(1)(a) GDPR and § 25(1) TTDSG. You may revoke your consent at any time.

We have the IP anonymization function activated. As a result, your IP address will be abbreviated by Google within the member states of the European Union or in other states that have ratified the Convention on the European Economic Area prior to its transmission to the United States. The full IP address will be transmitted to one of Google’s servers in the United States and abbreviated there only in exceptional cases. On behalf of the operator of this website, Google shall use this information to analyze your use of this website to generate reports on website activities and to render other services to the operator of this website that are related to the use of the website and the Internet. The IP address transmitted in conjunction with Google Analytics from your browser shall not be merged with other data in Google’s possession.

This website uses the “demographic characteristics” function of Google Analytics, to be able to display to the website visitor compatible ads within the Google advertising network. This allows reports to be created that contain information about the age, gender, and interests of the website visitors. The sources of this information are interest-related advertising by Google as well as visitor data obtained from third-party providers. This data cannot be allocated to a specific individual. You have the option to deactivate this function at any time by making pertinent settings changes for advertising in your Google account or you can generally prohibit the recording of your data by Google Analytics as explained in section “Objection to the recording of data”.

Hotjar

We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device’s IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf.

SECURITY: The security of your information is important to us and we will use reasonable security measures to prevent the loss, misuse or unauthorized alteration of your information under our control. However, given the inherent risks, we cannot guarantee absolute security and consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.

For security reasons and to protect the transmission of confidential content that you send to us as the site operator, our website uses an SSL or TLS encryption. This means that data that you transmit via this website cannot be read by third parties. We can be contacted via the email addresses provided. In this case, the personal data of the sender, i.e. the user, transmitted with the inquiry will be stored. For the personal data sent by email, this is the case when the respective request is answered and the conversation with the user has ended. The conversation is ended when it is clear from the circumstances that the matter in question has been conclusively clarified and no contract has been concluded. Inquiries regarding the contractual relationship are stored for the duration of the existing contractual relationship.

All personal data stored in the course of contacting us will be deleted in this case, provided that there are no legal retention periods to the contrary.
